11.12.2020 Sdas rejected C.R.M. 10285 of 2020 (via video conferencing) In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Kaliachak Police Station Case No. 499 of 2020 dated 01.07.2020 under Sections 21(c )/29 of the N.D.P.S. Act.

And In Re : Niranjan Roy .... petitioner Mr. Kazi M. Rahman ....for the petitioner Mr. Binay Panda Ms. Puspita Saha ...... for the State Statements of the witnesses show recovery of narcotic substance above commercial quantity i.e. over 1 kg. Of Brown Sugar from the joint possession of the petitioner and other accused persons. Petitioner was arrested from the spot. In view of the aforesaid facts and statutory restrictions under Section 37 of the N.D.P.S. Act, we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected.
