Mr. Arnab Chakraborty, Mr. Prasenjit Saha for the Petitioner Mr. Abhisekh Guha for the LIC The petitioner is serving as the Administrative Officer of the Life Insurance Corporation. He alleges that he has been illegally transferred in violation of the transfer policy.
The service regulations of the petitioner mentions that the grievance redressal mechanism shall be in place to deal with cases of violation of transfer policy/postings and the appellate authority for the grievance redressal in respect of the Administrative Officers in transfers within the Divisions are to be redressed by the Zonal Manager-in-charge.
The representation has been made by the petitioner to the Zonal Manager-in-Charge on 4th December 2020. The petitioner alleges that the same is yet to be considered and disposed of by the said authority.
The petitioner submits that he has crossed the age of 58 years and he is nearing retirement. At this stage, the police of Life Insurance Corporation do not permit transfer in the manner in which it has been made applicable in his case.
The learned advocate representing the Life Insurance Corporation submits that the petitioner has been transferred in view of the administrative exigency and according to the transfer police, an officer of the Life Insurance Corporation may be transferred at any post, at any place as per the need of the Corporation. As it appears that the prayer of the petitioner for reconsideration of his posting/transfer, the instant writ petition is disposed of by directing the respondent no. 3 being the Zonal Manager-in-Charge to take a decision with regard to the prayer of the petitioner strictly in accordance with the transfer policy of the Corporation and pass a reasoned order and intimate the same to the petitioner within 18th December 2020.
WPA 10377 of 2020 is thus disposed of.
