Public Prosecutor Mr. Tapan Bhattacharjee .. Advocate Mr. Sagnik Sankar Sikdar .. Advocate ... ... for the State There is a family dispute over share in ancestral property. Alleged forged instrument is in the control and custody of the investigating agency. In view of the aforesaid facts, we are of the opinion that custodial interrogation of the accused/petitioner may not be necessary and he may be granted anticipatory bail however, subject to strict conditions.

Accordingly, we direct that in the event of arrest, the accused/petitioner, namely Goutam Adhikary, be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten thousand only), with two sureties of like amount each, to the satisfaction of the arresting officer and also subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 and on further condition that the said petitioner shall meet the Investigating Officer once in a week until further orders.
