Mr. Aniket Mitra .... For the W.B.S.E.D.C.L The present application under Section 439 of the code of Criminal Procedure has been preferred by the petitioner in connection with Tarapith P. S. Case No. 16 of 2020 dated 13-02-2020 under Section 135(1)(a) of the Electricity Amendment Act, 2007(corresponding to Spl (E) Case 121/2020).

Pursuant to the order dated 15th December, 2020, Mr. Mitra learned advocate appearing for the WBSEDCL

submits that there has been a deposit of Rs.73,000/- on behalf of the petitioner.

Having regard to the same, we direct that in case the petitioner surrenders/appear before the regular court, the regular court, after ascertaining the genuinity of the documents so submitted on behalf of the petitioner, will allow the petitioner to be enlarged on bail subject to furnishing a Bond of Rs.10,000/-(Rupees ten thousand only) with two sureties of like amount subject to the satisfaction of the Special Court and subject to the conditions as the Learned Special Court deems fit and proper.

The application for bail being CRM 10333 of 2020 is, thus, disposed of.
