The petitioners allege that, despite an order having been passed under Section 14(1) of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 by the District Magistrate, North 24 Parganas, the concerned Executive Magistrate, being the respondent no.3, is not taking appropriate steps to implement the said order with police help.

It appears from the affidavit-of-service that service has been effected on some of the respondents, including the respondent no.3. However, none appears for any of the respondents.

Hence, W.P.A. 10423 of 2020 is disposed of by directing the respondent no.3 to implement (with police help) the order dated October 4, 2019 passed by the District Magistrate, annexed at page 22 of the

instant writ petition, under Section 14 (1) of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, immediately upon communication of this order to respondent no.3.

The petitioners shall communicate this order along with a fresh copy of the writ petition on respondent no.3 at the earliest to ensure implementation of this order.

There will be no order as to costs.
