Heard the learned advocates appearing for the petitioner and the school authorities. Records reveal that the petitioner was appointed as an Assistant Teacher in Bio Science (Pass Graduate), in normal section on deputation vacancy at Collins Institute (in short, the said school). Such appointment was ultimately approved with effect from 8th August, 2018 to 30th June, 2019 in compliance with the order dated 25th March, 2019, passed by the Principal Secretary, School Education Department, Government of West Bengal, as would be explicit from a memo dated 3rd April, 2019, issued by the respondent no.3. By the said memo dated 3rd April, 2019, the respondent no.3 also directed the authorities of the said school to take necessary action for disbursement of the benefits as per admissible Pass Graduate pay scale of ROPA 2009. Pursuant

to the said memo, the school authorities drew up an arrear claim for the period from 8th August, 2018 to 30th March, 2019 and submitted the same before the respondent no.3 by a memo dated 14th October, 2020 annexing all necessary documents. No one appears on behalf of the State respondents and no explanation is forthcoming as to why the arrear claim has not yet been disbursed in favour of the petitioner.

In view thereof, this Court directs the respondent no.3 to take all necessary steps towards disbursement of the arrear claim of the petitioner as forwarded to him by the school authorities vide memo dated 14th October, 2020, in accordance with law and subject to compliance of necessary formalities, if any, by the petitioner, within a period of eight weeks from the date of communication of this order along with a copy of the writ petition.

With the above observations and directions the writ petition is disposed of.

There shall, however, be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the learned advocates for the parties upon compliance of all necessary formalities.
