The grievance of the petitioner is that, despite the petitioner having applied for appointment of a Special Public Prosecutor for conducting a case, which was initiated by the petitioner (victim), no Special Public Prosecutor has been appointed under Section 24(8) of the Code of Criminal Procedure.

True to the submission made on behalf of the respondent no. 2 on the previous occasion, that is February 8, 2021, a copy of an order dated February 11, 2021, passed by the Legal Remembrancer & Ex-Officio Secretary to the Government of West Bengal, Judicial Department, is handed over in Court today

indicating that Mr. Mrinal Kanti Das, learned advocate of Barasat Court, has been engaged as the Special Public Prosecutor in place of Ms. Sephali Bhanja Chowdhury, the existing Special Public Prosecutor, in S. C. No. 70 of 2018 arising out of Khardah Police Station Case No. 571 of 2014 to conduct the case before the Third Additional District Judge, Barrackpore Court, District- North 24 Parganas, with immediate effect therefrom.

As such, the grievance ventilated in the writ petition is mitigated.

Accordingly, W. P. A. 10437 of 2020 is disposed of by keeping a copy of the order dated February 11, 2021 on record and granting liberty to the petitioner to pursue the matter before the appropriate court where S. C. No. 70 of 2018 is pending.

There will be no order as to costs.
