30.11.2022 rc/ct.no.10 Item No.119 WPA No. 10519 of 2020 Mr. Dilip Kumar Samanta ...for the petitioner Mr. Amal Kumar Sen Mr. Lal Mohan Basu Mr. Jaladhi Das ....for the State Mr. Sanat Roy ...for the respondent no.6 The grievance of the petitioner is that two permits were issued in favour of the respondent no. 6 in respect of a single vehicle. The petitioner submitted an objection in this regard before the concerned authority which has not been considered as yet.

It is submitted on behalf of the respondents that the earlier permit granted to the 6th respondent in respect of the vehicle in question was unconditionally surrendered by him before the State Transport Authority, West Bengal as a result of which the vehicle could not ply. Subsequent permit was issued in connection with the said vehicle by the registering authority, Purba Burdwan.

Learned counsel for the petitioner seeks a direction upon the authority to communicate the said fact to the petitioner at the earliest.

In view of the above, nothing further remains to be adjudicated in the writ petition and the same is disposed of accordingly.

However, the 5th respondent is directed to communicate the fact of surrender of the earlier permit as well as issuance of the subsequent permit in favour of the 6th respondent to the petitioner within one month from the date of communication of this order.

With the above observations and directions this writ petition is disposed of.

There shall be, however, no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
