This is an application under Article 226 of the Constitution of India wherein the writ petitioner is aggrieved by the provisional attachment of his bank account to the respondent authorities under Section 5 of the Prevention of Money Laundering Act, 2002.

When this writ petition is moved, Mr. Subrata Roy, counsel appearing on behalf of the Directorate of Enforcement, has placed the order passed under Section 5. A copy of the said order has now been handed over to the counsel appearing on behalf of the petitioner. In light of the above developments, the writ petitioner wishes to withdraw this writ petition with liberty to file afresh on the selfsame cause of action and upon the new development as instructed.

Accordingly, this writ petition stands dismissed as withdrawn with liberty as mentioned above.

I make it clear that I have not gone into the merits of this case at this stage.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
