A communication dated October 9, 2020 issued by the Kolkata Metropolitan Development Authority is under challenge in the present writ petition. Learned senior advocate appearing for the petitioner submits that, the petitioner was not issued a show cause notice calling upon the petitioner to respond as to why the petitioner should not be debarred. Moreover, the impugned communication is without any reasons so far as the debarment of the petitioner concerned.

The K.M.D.A. is represented.

It appears from the records that, the communication dated October 9, 2020 is non-speaking

in so far as the reasons as to why the petitioner was debarred one absent therein.

In such circumstances, the impugned order being without reasons is quashed.

This order will however not prevent the K.M.D.A. authorities from proceediing against the petitioner in accordance with law.

W.P.A. 10555 of 2020 is disposed of accordingly. Urgent certified Website copy of this order, if applied, be supplied to the parties, upon compliance of all requisite formalities.
