The defendant no.1 in Title Suit No. 388 of 2016 pending before the learned Civil Judge, Junior Division, 2nd Court at Paschim Midnapore has preferred this revisional application praying for expeditious disposal of the application under Order 39, Rules 1 and 2 of the Code of Civil Procedure.

It is contended on behalf of the defendant no.1 that the learned court below has been extending the ad interim order from time to time but has not heard out the application for temporary injunction since 2016. He prays that a direction must be passed upon the learned court below for expeditious disposal of the said application. Without going into the merits of the claims and counter-claims of the parties and without making any observation as to the merits of the claim of the petitioner, this revisional application is disposed of with a direction upon the learned court below to dispose of the application under Order 39, Rules 1 and 2 of the Code of Civil procedure

within one month from the next date fixed without allowing any unnecessary adjournments to either of the parties. If the suit is otherwise ready, the learned court below is directed to expedite the hearing of the Title Suit No.388 of 2016 and conclude the same preferably within a period of one year from date of communication of this order.

As it appears from the record that the opposite parties have already been served, no further direction for service is given.

The revisional application is disposed of.

There will be, however, no order as to costs. Urgent Photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Shampa Sarkar, J.)
