The grievance of the petitioner is directed against outstanding payment which had arisen in respect of a tender for which the petitioner was the successful bidder.

It is submitted on behalf of the petitioner that he has completed the works and has still not been paid by the State authorities. The petitioner relies on a representation dated 16th October, 2020 and submits that there has been no consideration of the representation by the concerned respondent being the respondent no.2.

The State is represented and submits that they have no objection if a direction be given to the respondent no.2 to consider the representation of the petitioner and give a right of hearing to the petitioner and pass a reasoned order within a stipulated time period.

In view of the submissions made on behalf of the parties, I direct the respondent no.2 to consider the representation of the petitioner dated 16th October, 2020 and pass a reasoned order within a period of four weeks from the date of communication of this order. I make it clear that the respondent no.2 will give a right of hearing to the petitioner before disposing off the representation of the petitioner.

I also make it clear that I have not gone into the merits of the case and nothing in this order will influence the respondent no.2 on the merits of the representation which he has been directed to consider. With the aforesaid directions, WPA 10577 of 2020 is disposed off. There will be no order as to costs. (Ravi Krishan Kapur, J.)
