...... petitioners Mr. R D Nandi Ms. A Sinha ...... for the petitioners Mr. Subrato Roy ...... for the State Petitioner no. 1 is the married sister in law of the victim housewife. Petitioner no. 2 is her husband. They do not ordinarily reside at the matrimonial home of the victim. Learned lawyer for the State opposes the prayer for anticipatory bail and submits that the victim committed suicide by setting herself on fire within three years of marriage. We have considered the materials on record including the statement of the victim. She has not implicated anyone in the said statement.

In view of the aforesaid fact and the other attending circumstances of the case, we are inclined to grant anticipatory bail to the petitioners.

Accordingly, we direct that in the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs. 10,000/- each with two sureties of like amount each, to the satisfaction of the Arresting Officer and also subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure, 1973.
