Learned advocate appearing for the petitioner submits that there is subsists an order of injunction passed in Title Suit No. 1412 of 2017 dated January 8, 2019. Despite such order, the petitioner was evicted from his residence by the private respondents. The police are inactive.

None appears for the respondent.

Entirety of the order dated January 8, 2019 passed in Title Suit No. 1412 of 2017 is not annexed to the writ petition.

Be that as it may, assuming that there is a violation of an order passed by the civil court, the petitioner is not remediless. A writ Court need not adjudicate as to whether an order of the Civil Court stands violated or not particularly when the civil suit is still pending.

In such circumstances, interference by a writ Court in not called for.

WPA 10662 of 2020 is disposed of accordingly. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance of the requisite formalities.
