The petitioners are aggrieved by a notice inviting tender published in December 2020. The petitioners have submitted that during the pendency of the writ application, the tender has been floated and work order already issued in favour of the successful tenderer. The work has also commenced.
The petitioners apprehend that the payment in respect of the said work will be siphoned off in an illegal manner.
The learned advocate appearing for the Staterespondents submits, upon instruction, that the tender was floated and work order was issued in favour of the successful tenderer by following the relevant rules.
The learned advocate appearing for the Pradhan and the Upa-Pradhan of the Nowahatu Gram Panchayat being the respondent nos. 5 and 6 herein submits, upon instruction, that there has been no irregularity at the time of floating the tender and issuance of the work order.
As it appears from the submissions of the parties that the work in terms of the work order has already been commenced, it will be appropriate at this stage to direct the Panchayat Development Officer being the respondent no. 4 herein to ensure that the work is being conducted in accordance with the work order that was issued and payments are being made in the proper manner.
WPA 10677 of 2020 stands disposed of.
Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
