Mr. Kallol Kumar Maity ..for the petitioner This is a suit for declaration and permanent injunction. The plaintiff in Title Suit No. 205 of 2017, pending before the learned Civil Judge, Junior Division, Haldia, District Purba Medinipur prays for expeditious disposal of the suit along with the application for temporary injunction pending before the learned Court below.

This Court is conscious of the fact that due to the pandemic situation, the learned Court below could not hear out the application expeditiously. It also appears that written objection has been filed by the opposite parties. Without going into the merits of the case and without making any observations with regard to the claim of the petitioner, this revisional application is disposed of with a direction upon the learned Court below to hear out the application for temporary injunction within two weeks from the next date fixed without granting unnecessary adjournments to either of the parties.

Once the application for injunction is disposed of the learned Court below shall make all necessary endeavors to accept the hearing of the suit. The suit should be heard and disposed of as expeditiously as possible, preferably within a period of one year.

The petitioner is directed to serve a copy of the revisional application along with a server copy of this order upon the opposite party no.1 within a week from date. This revisional application is disposed of.

There will be however no order as to costs.

Urgent photostat certified copy of this order be given to the parties on priority basis, if the same is applied for. (Shampa Sarkar,J.)
