Ms. Amita Gaur For the State The present application under Section 439 of the Code of Criminal Procedure has been preferred by the petitioner in connection with Chapra Police Station Case No. 01 of 2020 dated 03.01.2020 under Sections 302/201/120B of the Indian Penal Code.

The learned advocate appearing for the petitioner submits that the petitioner is in custody since 9th January, 2020 and charge sheet has been submitted on 11th March, 2020. The learned advocate additionally submits that considering the period of detention and the progress of the case, the petitioner may be released on bail on any condition.

Mr. Ahmed, learned advocate appearing for the State opposes the prayer for bail and draws the attention of this Court to the seizure list by which incriminating materials were recovered as also the statement of the father of the deceased recorded under section 164 of the Code of Criminal Procedure.

Having regard to the nature of allegations, gravity of the offence and the complicity of the present petitioner, we are of the opinion that the petitioner is not entitled to be released on bail at this stage. As such, the prayer for bail of the petitioner is rejected.

Accordingly, the application for bail, being CRM No. 10548 of 2020, is dismissed.
