Chowdhury Mr. Argha Das .... for the petitioner Mr. Imran Ali Ms. Manasi Roy ... for the State This is an application for expeditious disposal of a trial under Sections 201, 306 and 498A read with Section 120(B) of the Indian Penal Code.

Let a copy of this application be served upon Mr. Imran Ali, learned Advocate and Ms. Manasi Roy, learned advocate who ordinarily appear on behalf of the State. Their engagement may be regularised by the competent authority of the State in due course. Learned counsel for the petitioner submits as follows. The petitioner is the accused in this case. He is a government servant and he is sustaining himself with an adjusted salary. Although the F.I.R. was lodged in 2002 and after submission of charge-sheet, trial commenced in 2005, till date only two out of a total number of 24 witnesses could be examined. A report about the death of an accused was sought by the learned trial court and nearly three years went in the process. The proceeding has remained pending for no fault on the part of the present petitioner.

I have heard the submissions of the learned advocates of the petitioner and the State and have perused the revision petition and the supplementary affidavit filed by the petitioner containing the latest order sheet.

No prejudice would be caused any one if a direction is passed for an expeditious disposal of the trial. It appears that a substantial delay has been occasioned in the proceeding.

In view of the above and in the interest of justice, I request the learned trial court to conclude the trial as expeditiously as possible without granting any unnecessary adjournment to any of the parties, preferably within a period of one year from the next date of hearing.

With these observations, the revisional application is disposed of.
