SHANKAR DIN SETH Mr. Nilanjan Adhikari ..for the petitioner The defendant in Title Suit No. 50 of 2013, pending before the learned Civil Judge, Junior Division, 1st Court, Barasat, District North 24 Parganas has filed this revisional application praying for expeditious disposal of the said title suit.

Reliance is placed on an order dated July 29, 2019, by which a learned Judge of this Court had directed that the suit should be disposed of preferably within March 31, 2020. Unfortunately, the said order was not complied with. During the period after March 31, 2020, the Court could not function properly due to the pandemic situation. However, in view of the age of the suit, this Court is the opinion that the justice would be sub-served if the learned Court below is directed to dispose of in Title Suit No.50 of 2013 as expeditiously as possible, preferably within a period of six months from the next date fixed without granting unnecessary adjournments to either of the parties.

This Court has not gone into the merits of the claim of the petitioner. The learned Court below will decide the issue independently.

The petitioner is directed to serve a copy of the revisional application along with a server copy of this order upon the opposite party/plaintiff within a week from date. This revisional application is disposed of.

There will be however no order as to costs.

Urgent photostat certified copy of this order be given to the parties on priority basis, if the same is applied for. (Shampa Sarkar,J.)
