The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite parties, as such, service of notice of the present revisional application upon the opposite parties is dispensed with. The petitioner filed a suit for eviction of the opposite parties.

The suit was dismissed aggrieved thereby the petitioner has preferred the connected appeal being Ejectment Appeal No. 53 of 2018 pending before the learned Additional District Judge 2nd Fast Track Court Alipore, District 24-Parganas (South).

Mr.

Bhattacharyya, learned Counsel appearing on behalf of the petitioner prays for direction upon the learned Appeal Court below for expeditious disposal of the said appeal. The Courts are resuming normal functioning solely during this COVID-19 pandemic period, at

this stage direction for disposal of any pending lis within a specified period is not warranted.

However, this Court hopes and trusts that keeping in view the nature of the appeal learned Appeal Court below shall make all endeavour to dispose of the said appeal expeditiously without granting any unnecessary adjournment to either of the parties.

C.O 1561 of 2020 is disposed of with the above terms.

There shall be no order as to costs.
