In the matter of : An application under Section 482 read with Section 483 of the Code of Criminal Procedure in connection with NDPS Case No.136/2019 arising out of Basirhat P. S. Case No.955/2019 dated 16.09.2019 under Section 21(C)of the N.D.P.S Act, 1985 passed by the Ld. Addl. District and Sessions Judge, 6th Court, Barasat, North 24 Parganas.

The learned advocate for the petitioner is aggrieved by the factum of petitioner being detained in custody for more than 14 months and yet there is no progress in the court proceedings before the court below. According to the learned advocate for the petitioner, the petitioner was arrested on 16.09.2019, charge-sheet was submitted on 30.09.2019 and the supplementary charge-sheet was submitted on 18.11.2020. Although the prosecution proposes to examine six witnesses

but till date the learned trial court could not overcome the stage of consideration of charge.

Having regard to the anxiety of the petitioner and as the next date has been fixed on 12.01.2021, I direct the learned trial court to complete the stage of consideration of charge on 12.01.2021 or within a week thereafter. The learned court thereafter would fix a schedule at regular intervals so that the examination of the prosecution witnesses can be completed within a reasonable period of time.

With the aforesaid observations, CRR 1787 of 2020 is disposed of.
