Mrs. Sayanti Santra For the State The present application under Section 439 of the Code of Criminal Procedure has been preferred by the petitioner in connection with Lake Police Station Case No. 314 of 2010 dated 23.12.2010 under sections 302/34/394/120B of the Indian Penal Code.

The learned advocate appearing for the petitioner submits that the petitioner has been falsely implicated and he is in custody for nine years ten months. The delay, which has occasioned towards conclusion of trial, is attributable to the prosecution and in view thereof, further detention of the petitioner is not necessary.

The learned advocate appearing for the State submits, upon instruction, that the examination and cross-examination of all the witnesses have been completed and 29th January, 2021 is

the date fixed for arguments. Let the written instruction, as produced, be kept on record.

Having heard the learned advocates appearing for the respective parties and considering the fact that the matter has been fixed for arguments on 29th January, 2021, we are not inclined to allow the petitioner's prayer for bail. Accordingly, the application for bail, being CRM No. 10660 of 2020, is dismissed.
