The writ petitioner is aggrieved by the alleged inaction on the part of the police authority to stop alleged unauthorized construction by the private respondent nos. 5 and 6 in spite of the order of the learned Executive Magistrate dated 2nd November, 2020 under Section 144 of the Code of Criminal Procedure.

Mr. Bihani, learned advocate appearing for the State respondents has submitted a report of the Officer-in-Charge of the concerned police station and on perusal of which it appears that police have taken appropriate action against the alleged private respondents and has filed charge sheet against them. Considering the submissions of the parties and on perusal of record and the police report filed in

court today, I am of the view that petitioner has got no case to get any order in view of the facts discussed above.

Accordingly, WPA 10865 of 2020 is dismissed.

Let the report of the police filed through Mr. Bihani, learned advocate be kept on record.
