For the State The grievance of the petitioner is directed against nonconsideration of his representation dated 24th September, 2020 (appearing at page 29 of the writ petition as Annexure P/6). It is submitted on behalf of the petitioner that notwithstanding submission of the representation to the respondent No. 4, the same has not yet been disposed of.
Mr. De, appearing for the State relies on paragraph 6 of the writ petition to contend that the petitioner is a post acquisition transferee and is not entitled to any compensation. However, Mr. De submits that he has no objection if the aforesaid representation be considered in accordance with law by the respondent No. 4 within a fixed time frame.
In view of the submissions made on behalf of the parties, W.P.A. 10869 of 2020 is disposed of by directing the respondent No. 4 to consider the representation of the petitioner dated 24th September, 2020 within a period of two months from date after
giving a right of hearing to all the parties. It is made clear that the respondent No. 4 will not be bound by any observation or any finding made in this order and will consider the representation of the petitioner strictly in accordance with law.
There shall be no order as to costs.
