......Petitioners.
Ms. R. De Ghosh Mr. S. Paul ...for the petitioners.
Mr. S.G. Mukherjee, Ld. PP.
Mr. Arijit Ganguly ...for the State.
Ms. Soumita Dutta ...for the Opposite Party Nos.2 & 3. Report submitted by the investigating officer Shakespeare Sarani P.S. be kept with the record. Initially the case was registered on the basis of a complaint filed by the Manager, Simplex Infrastructures Limited, wherein the dispute was relating to certain manufactured purchase orders being placed by the accused opposite parties. Report of the investigating officer reiterates the contentions in the connected application being CRAN 1 of
2020, wherein the parties have filed a joint compromise application.
In view of the fact that the nature of the dispute complained of relates to commercial transaction and are private and personal in nature and no public money is involved, I am of the opinion that further continuation of the investigation is not warranted and as such all further proceedings arising out of the Shakespeare Sarani P.S. Case No.54 dated 18.03.2020 should be quashed.
Accordingly, the joint compromise petition being CRAN No.1 of 2020 is allowed.
Consequently, the revisional application being CRR 1788 of 2020 is disposed of.
Urgent certified copy of this order be immediately made available to the parties subject to compliance with all requisite formalities.
