38 (D/L) 22-07-2021 Ct. No.08 debajyoti/BR (Through Video Conference) WPA 10934 of 2020 Sk. Abu Musa & Ors.

Vs.

The State of West Bengal & Ors.

Mr. Tarasankar Samanta ... For the Petitioners.

Petitioners seek certified copy of a deed presented for registration.

None appears for the State.

It appears that the deed was retained on the allegation of forged stamp paper being seized. In such circumstances, it would be appropriate to direct the authorities to issue certified copy of the deed presented for registration within a period of six weeks from date to the petitioner, upon payment of the balance of the Stamp Duty, if any, and upon the petitioner complying with all other formalities and paying the costs and charges for the certified copy.

This order will not prevent the authorities from continuing with the pending criminal proceedings with regard to forged stamp papers and from initiating any fresh proceeding for forged stamp papers, if found. WPA 10934 of 2020 is disposed of accordingly. ( Debangsu Basak, J. )
