The subject matter of the revisional application relates to a proceeding under Section 144(2) of the Code of Criminal Procedure, which was pending before the learned Executive Magistrate, Barasat, North 24 Parganas.
The subject matter of challenge relates to the order dated September 9, 2020.
In view of the nature of the proceedings and the statutory compliances required for validation of such orders, I am of the opinion that the main proceedings before the learned Executive Magistrate has become infructuous and the same cannot be proceeded in view of the provisions of law.
Accordingly, CRR 1804 of 2020 has also become infructuous. Thus, the revisional application being CRR 1804 of 2020 is dismissed as infructuous.
