Mr. Goutam Guria .................for the petitioners Affidavit of service filed in Court today is taken on record. Despite service, none appears for the respondents. The petitioners have alleged in the writ petition that private respondent no. 8 with his associates, being a gang of dangerous and desperate miscreants of the locality, in order to grab the plot in question with the help of the ruling political party, recently took attempt to construct rooms forcibly over the plot in question by changing nature and character of the agricultural land. The petitioners have further averred that the private respondent does not have any right, title and lawful possession over the land in question and they are forcibly trying to construct house over the plot in question without any authority in law.

It appears from the submissions of the petitioners that the issue involved herein is purely civil in nature. The Writ Court is not the appropriate forum to decide upon the right, title and interest of any property. The petitioners shall be at liberty to approach before the appropriate forum in accordance with law, if so advised. The writ petition stands disposed of.
