Mr. Goutam Guria .................for the petitioners Mr. N.C.Bihani Mrs. Papiya Banerjee ..................for the State The petitioner has alleged in the writ petition that private respondent nos. 8 and 9 and their associates in collision with some anti-social elements of the locality obstructed the petitioner to construct the dwelling house under the Government scheme without any authority in law. It is also the case of the petitioner that due to such illegal and forcible obstruction, he cannot continue with the construction.

It appears from the submissions of the petitioner that the issue involved herein is purely civil in nature. The Writ Court is not the appropriate forum to decide upon the right, title and interest of any property. The petitioner shall be at liberty to approach before the appropriate forum in accordance with law, if so advised. The writ petition stands disposed of.
