The petitioners are the defendants in Title Suit No.129 of 2015 pending before the learned Civil Judge (Junior Division), 2nd Court, Serampore, Hooghly. The petitioners are aggrieved by the unnecessary delay in the disposal of the suit. It is submitted that the suit is at the stage of evidence. It is prayed that the learned Court below may be directed to dispose of the suit expeditiously.

Having considered the records, this Court feels that the defendants have also been responsible for delay in view of the adjournments prayed for. However, it is assured that the defendants will not take any unnecessary adjournment in future.

Under such circumstances, this Court feels that the learned Court below may be requested to dispose of the Title Suit No.129 of 2015 as expeditiously as possible preferably within a period of one year from the date of communication of

this order without granting unnecessary adjournments to either of the parties.

It is made clear that this Court has not gone into the merits of the claims and counterclaims of the parties and the learned Court below shall proceed in accordance with law. If any interlocutory applications are pending, the same shall also be disposed of within the aforementioned period. The learned Advocate-on-record for the petitioners is directed to serve a copy of this revisional application upon the opposite party along with a server copy of this order within a period of seven days.

This revisional application is, thus, disposed of. There will be, however, no order as to costs. Urgent photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Shampa Sarkar, J.)
