Counsel for the petitioner complains of police inaction in tracing out his minor daughter. A complaint was lodged with the Burdwan Police Station on 12th November, 2020.
Counsel for the State submits that an FIR was registered under Sections 363 and 365 of the IPC on 4th November, 2020. Upon receiving information as to the whereabouts of the girl, the police went to search the area and the girl surrendered before the Sessions Judge, Murshidabad.
The victim girl recorded a statement before the Sessions Judge that she was in love with the said Nirmal Kumar Ghosh and has been leading a conjugal life with him for sometime.
The learned Sessions Judge, therefore, did not direct police custody as there
was no need for custodial interrogation of the respondent no. 6.
In view of the above, this Court does not find inaction on the part of the police.
The writ petition therefore fails and is hereby dismissed.
There will be no order as to costs.
All parties are directed to act on a server copy of this order on usual undertaking.
