Mr. Syed Nurul Arefin ....for the petitioner Mr. Subhrangsu Panda ...for the State By an order dated May 15, 2018 passed in WP 853 (W) of 2018 (Ranjit Ghosh vs. The State of West Bengal & Ors.) by a Co-ordinate Bench of this Court directed higher scale of pay from the date of recommendation of the concerned Madrasah to be allowed to the petitioner therein. The petitioner herein is also similarly situated and is entitled to a graduate scale of pay benefit from 01.05.2000 to 28.02.2015 which comes to a sum of Rs. 3,67,728/-.

The learned counsel for the State fairly submits that the petitioner similarly situated to that of Ranjit Ghosh and is entitled to the same benefit.

Hence, WPA 11075 of 2020 shall stand allowed directing the D.I. of Schools (SE),

Paschim Medinipur and the Director of Madrasah Education being respondent nos. 2 and 4 to immediately release within a period of one month the said sum of Rs. 3,67,728/- to the petitioner.

It is made clear that if payment is not made within a period of one month from the receipt of a copy of this order, the amount shall carry interest @ 6% per annum on and from 01.05.2000 till the date of actual payment.

The order dated May 15, 2018 be kept with the record.

With the aforesaid direction, the instant writ petition is disposed of.

All parties are directed to act on a server copy of this order on usual undertakings.
