Petitioner Mr. Narayan Chandra Das ...for the petitioner Mr. Rudradipta Nandy Ms. Manisha Sharma ...for the State Learned advocate appearing for the petitioner submits that the petitioner is innocent person and was never staying at the place of occurrence and has been falsely implicated in connection with the instant case. On conclusion of investigation chargesheet has already been submitted.

Mr. Nandy, learned advocate appearing for the State opposes the petitioner's prayer for anticipatory bail. We have perused the statement of the witnesses, the seizure which have been effected. Having regard to the fact that the investigation of the case has already been completed, we are of the opinion that custodial interrogation of the petitioner may not be warranted in connection with the instant case. As such the prayer for anticipatory bail is allowed.

Accordingly, we direct that in the event of arrest the petitioner, namely, Pratim Kumar Laha alias Pratim Laha, shall be released on anticipatory bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973..

This order of anticipatory bail will remain in force for a period of four weeks within which the petitioner would surrender before the learned Court and pray for regular bail.

Accordingly, the application being C.R.M. No. 10785 of 2020 is disposed of.
