This is an application for expeditious disposal of the Title Suit No.427 of 2019 pending before the learned Civil Judge (Senior Division), 5th Court at Alipore, District-24Parganas (South). It is submitted that the application for temporary injunction under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure has not yet been disposed of and as such the learned Court below be directed to dispose of the said application and also expedite the hearing of the suit. Having considered the records, this Court feels that the hearing of the application for temporary injunction should be expedited and the same should be disposed of within a period of one month from the next date fixed.

It is also made clear that unnecessary adjournments should not be given to the defendants and after the disposal of the application for temporary injunction, the hearing of the

suit should also be expedited along with other applications, if any.

It is made clear that this Court has not gone into the merits of the claims and counterclaims of the parties and the learned Court below shall proceed in accordance with law independently.

The learned Advocate-on-record for the petitioner is directed to serve a copy of this revisional application upon the opposite party No.7, Sri Sudip Biswas, and also his learned Advocate appearing in the learned Court below along with a server copy of this order within a period of seven days. This revisional application is, thus, disposed of. There will be, however, no order as to costs. Urgent photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Shampa Sarkar, J.)
