He was functioning as Record Clerk in the United India Insurance Co. Ltd. at the regional office at Chowringhee, Kolkata. The application for compassionate employment was made for the first time by the younger daughter on 25th September, 2020.

Learned counsel for the respondent-Insurance Company submits that after receipt of the application, her client did not have occasion to look into the same. She also submits that receipt of the application itself is in doubt. Be that as it may, since the respondents have not yet taken any decision on the petitioner's request, the respondent no.2 herein is directed to consider and dispose of the petitioner's representation dated 25th September, 2020, strictly in accordance with law and the applicable Rules therefor. It is made absolutely clear that this Court has not entered into the claims made by the petitioner or the propriety thereof. The respondent no.2 may consider the petitioner's case independently and strictly in accordance with the applicable

Rules and law preferably within a period of four months from the date of communication of a copy of this order. With the aforesaid observations, the writ petition is disposed of.

In view of disposal of the writ petition, the connected application being CAN 1 of 2021 is also disposed of. There shall be no order as to costs.
