The petitioners allege that the private respondents are making illegal and unauthorized construction.

The petitioners claim that the representations were made before the Rishra Municipality objecting to the illegal construction being made by the private respondents.

It appears from the annexures to the writ petition that a representation was made by the petitioner no.1 on 27th November, 2020 and another representation was made by the petitioner No.2 on 3rd February, 2020. None of the aforesaid two representations mentions the address where the illegal construction is being made.

The details of the alleged illegal construction are also not clear from the aforesaid representations.

In view of the above, leave is granted to the petitioners to file a composite representation before the Rishra Municipality giving the details of the illegal construction that is allegedly being made by the private respondents.

In the event such a representation is made, the Rishra Municipality shall consider the same, strictly in accordance with law, within a period of eight weeks from the date of receipt of a copy of the representation. W.P.A. 11120 of 2020 is disposed of.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
