Amal Kumar Bera v. State Of West Bengal And ORS.
Court No. 17 WPA 11125 of 2020 Amal Kumar Bera 28.01.2022 Vs.
The State of West Bengal & Ors.
(AD 4) (S. Banerjee) (Via Video Conference) Mr. Santanu Mukherjee ... for the petitioner Mr. Supriyo Chattopadhyay Mr. Sabyasachi Mondal ... for the State Ms. Koyeli Bhattacharya ... for the WBBSE The petitioner has filed this application for correction of his date of birth from 07.11.1964 to 07.11.1965 on the basis of a letter of the Sub-Inspector of Schools, Mugaberia Circle, Purba Medinipur. Learned advocates for the State and also for the West Bengal Board of Secondary Education have submitted that the petitioner passed Madhyamik examination in the year 1982. It also appears from record.
The petitioner is a contractual Siksha Bandhu under Sarva Siksha Mission who will retire from his service on attainment of 60 years. On the basis of his date of birth as 07.11.1964, his year of retirement would be 2024. Though he passed Madhyamik examination nearly 40 years back, he has come before this court for correction of his date of birth in the year
2020 by filing this writ application. He has not shown any reason as to why he did not approach the Board immediately after 1982 for correction of his date of birth. Just before the age of retirement such correction of date of birth is not permissible.
Hence, I do not find any merit in this writ application and the same is dismissed.
