Mr. Sudip Ghosh, Mr. Bitashok Banerjee ... For the State. The present application under Section 439 of the code of Criminal Procedure has been preferred by the petitioner in connection with Belur P.S. Case No. 01 of 2020 dated 01-012020 under Sections 302/120B/34 of the Indian Penal Code. Heard the learned advocates appearing for the parties and considered the materials available in the case diary. Prima facie, it appears that the extent of complicity of the petitioner is similar to the co-accused persons, who have already been granted bail by co-ordinate Bench of this Court. Upon completion of investigation, chargesheet has also been submitted and as such, we are of the opinion that further detention of the petitioner, who is in custody for about 385 days, is not warranted.

Accordingly, we direct that the petitioner, namely, Debabrata Sen @ Babai @ Kartick shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Howrah and on a further condition that the petitioner shall attend the court regularly on the specified dates.

The application for bail being CRM 10835 of 2020 is, accordingly, disposed of.
