The grievance of the petitioner is that the private respondents encroached upon government land illegally. A report is filed by the State authorities. It appears from the report that the Assistant Engineer, Haldia Highway Sub-division P. W. (Roads) Directorate, vide letter dated 3rd September, 2021, informed that the concerned Block Land and Land Reforms Officer demarcated the government land and identified the two encroachers who occupied portions of the said land. Proceedings under Section 10 of the West Bengal Highways Act, 1964 for removal of the said encroachment has commenced and notice under Section 10(1) of the said Act has been issued upon tthe encroachers.

The petitioner prays for completion of the said proceeding within a stipulated time.

Having heard the submissions made on behalf of the parties and material on record including the report filed on behalf of the State, I dispose of the writ petition with a direction upon the respondent No.7 to complete the proceeding under Section 10 of the 1964 Act within a period of three months from the date of communication of this order, in accordance with law.

Accordingly WPA 11154 of 2020 is disposed of. However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
