Apprehending arrest in connection with Murarai P.S. Case No.397 of 2018 dated 11.10.2018 under Section 135(1) of the Electricity Act, the petitioner has filed the present application. The learned advocate appearing for the petitioner undertakes to pay 50% of the finally assessed amount of Rs.4,14,708/- within a period of four weeks from date.

Mr. Mitra, learned advocate appearing for the WBSEDCL submits that the final assessment amount is Rs.4,14,708/-. In view of the undertaking given by the learned advocate for the petitioner, we direct that, in case, the petitioner appears before the learned Special Court after paying the said amount within a fortnight, the learned Special Court would check the genuineness and authenticity of the payment being made and thereafter release the petitioner on bail, in case the petitioner is ready to furnish a bond of `10,000/- with two sureties of like amount each, one of whom must be local.

The petitioner shall not be arrested in the meantime till he surrenders in terms of the aforesaid directions. The order of not to arrest shall be valid till 5th April, 2021. With the aforesaid observations, the application for bail, being CRM No. 10906 of 2020, is disposed of.
