Mr. Sharma, learned advocate appearing for the petitioner submits that the petitioner is the headmaster of a school who is aged about 45 years and he has been falsely implicated in the instant criminal proceedings because of an acquaintance with the de fact complainant, who is aged about 43 years.

Learned advocate appearing for the petitioner further submits that as the investigating has been concluded and the petitioner is a permanent resident of the address referred to in

the petition, further detention of the petitioner is unwarranted and he may be released on bail on any stringent condition. Mr. Mukherji, learned Public Prosecutor appearing on behalf of the State opposes the prayer for bail of the present petitioner and submits that the petitioner had allured the de facto complainant and in fact impersonated himself with a different name with which he opened an account in the social media.

He further submits that from jail the petitioner had been threatening the de facto complainant victim. Ms. Patel, learned advocate appearing for the de facto complainant also opposes the bail prayer of the present petitioner.

Having regard to the fact that charge-sheet has already been submitted and the case is yet to be committed to the court of sessions and the fact that there are material appearing against the present petitioner interfering with the course of justice, we are not inclined to release the present petitioner on bail at this stage.

Accordingly, the prayer for bail of the present petitioner is rejected.

With the aforesaid observations, the application being CRM 10921 of 2020 is disposed of.
