Apprehending arrest in connection with Tiljala P.S. Case No. 320 of 2020 dated 03.11.2020 under Section 135(1)(a)(b) of the Electricity Act, 2003, the present application has been preferred.

Mr. Zaman, learned advocate appearing for the petitioners submits that on 23rd December, 2020, the petitioners have paid 50% of the claimed amount to the CESC authorities.

Such fact has not been disputed by Ms. Biswas, learned advocate appearing for the CESC authorities. In view of the aforesaid, the petitioners are directed to surrender before the learned Special Court within a fortnight and pray for regular bail.

The learned Special Court would release the petitioners, namely, 1. Safiul Rahaman, 2. Hafizur Rahaman,

3. Mofizur Rahaman and 4. Azizur Rahaman, on regular bail upon furnishing a bond of Rs.10,000/- (Rupees Ten thousand only) each, with two sureties of like amount each, one of whom must be local and on condition that the petitioners shall attend the Special Court on each and every date, so specified.

Till the petitioners surrender before the learned Special Court, they shall not be arrested for a period of fortnight from date.

With the aforesaid observations, the application for anticipatory bail, being CRM 10927 of 2020 is disposed of. All parties shall act on the server copies of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.) (Tapabrata Chakraborty, J.)
