Mr. Soumik Ganguli For the State Apprehending arrest in connection with Santipur P.S. Case No. 237 of 2017 dated 04.06.2017 under sections 420/409/34 of the Indian Penal Code, the petitioner has filed the present application. The learned advocate for the petitioner submits that the petitioner is innocent of the charges and has been falsely implicated in the instant case. Additionally, the learned advocate submits that on any condition the petitioner may be granted the relief, as prayed for. The learned advocate for the State opposes the petitioner's prayer for anticipatory bail and submits that it was during the demonitization the defalcation has taken place through SBI Kiosk. The petitioner was primarily one of the persons, who is said to be responsible on the basis of the available materials collected by the investigating agency. We have perused the case diary and on an assessment of the materials so available, we find prima facie there are incriminating materials appearing against the present petitioner. As such, we are not

inclined to extend the privilege of anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected. The application for anticipatory bail, being CRM 10929 of 2020 is, thus, rejected.
