CRM No.10935 of 2020 27.01.21 In re: An application for bail under Section 439 of the Code of Criminal Procedure filed in connection with Shasan Police Station Case No.09 of 2020 dated 01.02.2020 under Sections 302/201/34 of the Indian Penal Code;

(S.R.) Sl.28 Ct.28 And In re: Abdul Nayim Molla @ Mintu ... petitioner.

Mr. Kallol Kumar Basu Md. Jannat Ul Firdous ... for the petitioner.

Ms. Zareen Nasena Khan Ms. Sreeparna Das ...for the State.

Mr. Basu, learned advocate appearing for the petitioner submits that the petitioner has been falsely implicated. There is no incriminating material on record against the petitioner. Upon completion of investigation charge sheet has also been submitted and as such, further detention of the petitioner, who is in custody for more than 336 (three hundred thirty six) days is not necessary. Ms. Khan, learned advocate appearing for the State opposes the petitioner's prayer for bail and draws our attention to the several documents in the case dairy.

Having heard the learned advocates and considering the materials in the case diary, the statements of the father and mother of the deceased recorded under Section 164 of the Code of Criminal Procedure and the extent of complicity of the petitioner in the alleged offence, we are not inclined to grant bail to the petitioner at this stage. Accordingly, the application for bail being CRM No.10935 of 2020 is dismissed.
