Mr. Soumitra Mukherjee, Mr. Avra Mazumder ... for the State The petitioner prays for implementation of the Order bearing No. FC 1882/WBSRDA/2E-58/2018 dated 20th November, 2018 issued by the Joint Secretary and the Joint Chief Executive Officer of the West Bengal State Rural Development Agency.
The petitioner claims that the bills raised in accordance with the said Order have not been cleared by the respondent authority till date.
The petitioner made representations before the Executive Officer of the said Agency but the representations have not been answered by the respondents till date. The learned Additional Advocate General appearing on behalf of the State respondents submits, upon instruction, that necessary directions may be passed for consideration of the representations made by the petitioner.
The instant writ petition is accordingly disposed of by directing the respondent No. 5, West Bengal State Rural Development Agency to consider the representations made by the petitioner annexed at page Nos. 42, 54, 70, 92 and 102 of the writ petition in consultation with the audit branch of the respondent No. 4, Finance Department, State of West Bengal, within a period of twelve weeks from the date of communication of a copy of this order, after giving an opportunity of hearing to the representative of the petitioner and to pass a reasoned order and communicate the same to the petitioner immediately thereafter. It is made clear that the Court has not entered into the merits of the claim of the petitioner and all points are left open to be decided by the aforesaid respondents at the time of consideration of the representations of the petitioner.
The petitioner is directed to forward a copy of the writ petition along with all annexures to the aforesaid respondents for the purpose of compliance of the order passed by this Court.
WPA 10841 of 2020 stands disposed of.
Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
