08.02.2021 S/L No. 19 Court No.13 s.biswas WPA 11280 of 2020 Nazma Sardar Vs.

The State of West Bengal & Ors.

(Through Video Conference) Mr. Anjan Dutta ... ... for the petitioner Mr. Swapan Kumar Dutta, Ld. AGP Ms. Soumi Guha Thakurta ... ... for the State The facts of the case are that the petitioner had submitted an application for the post of ASHA Karmi on 15th July, 2020, which was sent by the Registered Post. The said postal item could not be delivered by the postal authorities as evident from a letter dated 20th October, 2020, due to the pandemic. The authorities however received other applications during the same period, and have conducted interview on 4th and 5th November, 2020 and the selection process is stated to be over. Counsel for the State, Mr. Swapan Kumar Dutta, learned Senior Advocate further submits that the petitioner's application was received belatedly and rejected after due consideration primarily on the ground of delay. No relief therefore can be granted to the petitioner and it is reasonably expected that the appointment in this regard has already been made. It is curious to note that all other applications for the post have been received in

time and only the petitioner's application arrived late by reason of the pandemic.

For the reasons stated above while this Court has sympathy for the petitioner, no relief can be granted. With the above observation WPA 11280 of 2020 is disposed of.

There shall however be no order as to costs.

Urgent Photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
