Mr. Sanyal, learned Counsel appearing for the petitioner submits that a representation (at page 50 annexure P-3) has been made by the petitioner way back on 1st December, 2020 but the same has not been considered by the Secretary, Higher Education Department, Government of West Bengal till date. Learned Counsel appearing for the State is present.

Heard all the parties.

The Secretary, Higher Education Department, Government of West Bengal is requested to consider the representation of the petitioner. The writ petitioner is directed to serve a copy of this order along with the writ petition to the Secretary, Higher Education Department, Government of West Bengal. The Secretary, Higher Education Department, Government of West Bengal is

requested to give an opportunity of hearing to the petitioner and to allow the petitioner to produce all the relevant documents including the order passed by His Lordship Hon'ble Justice Arindam Sinha dated 14th February, 2018 in W.P.166 (W) of 2018 at the time of hearing and, thereafter, the Ld. Secretary will pass a reasoned order within eight weeks from the date of communication of this order to him. The Secretary, Higher Education Department, Government of West Bengal is also requested to communicate the reasoned order to the petitioner at an earliest.

The writ petition being WPA 11299 of 2020 is accordingly disposed of.

There will be no order as to costs.

Since no affidavit have been invited, the allegations made in the writ petition are deemed to have been denied.

Urgent certified website copy of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
