rc/Ct.No.10 Item No.14 WPA No. 11331 of 2020 Mr. U.S.Chattopadhyay Mr. S.S.Chattopadhyay ...for the petitioner Mr. Susovan Sengupta Mr. Subir Pal ...for the State Mr. Srijan Nayak Mr. Rituparna Maitra ...for the respondents no.3&4 Mr. Madan Mohan Roy ...for the respondents no.6,7,8&9 Mr. Sanjay Saha ...for the respondents no. 10&11 The grievance of the petitioner is directed towards illegal, gross malpractice and misappropriation of funds by the respondent no. 6, Sahajadpur Samabay Krishi Unnayan Samity (in short, "SSKUS"). The petitioner alleges that there is connivance amongst of the Chairman, Secretary and Manager of the said SSKUS and there is large scale siphoning of public money in respect of the purchasing paddy for the financial year 2016-17. The petitioner relies on diverse documentary evidence.

In this background, the petitioner at this stage prays that the respondent no. 1 be directed to conduct an enquiry and file a report as whether there is gross malpractice,

misappropriation and siphoning of fund pertaining to the respondent no. 6 for the financial year 2016-17. Mr. Susovan Sengupta, advocate appearing on behalf of the State fairly submits that he has no objection if the respondent no. 1 is directed to carry out such enquiry. In view of the submissions made by the parties the respondent no. 1 is directed to carry out an enquiry pertaining to the complaint of the petitioner for illegal, gross malpractice and misappropriation of funds by the respondent no. 6, Sahajadpur Samabay Krishi Unnayan Samity at Village and Post Office - Hahisagote, Police Station - Contai, District - Purba Medinipur within a period of two months from the date of communication of this order and to pass a reasoned order which he will communicate to the petitioner and other affected parties.

It is needless to mention here that the respondent no. 1 will give right of hearing to the petitioner and other affected parties before passing his reasoned order.

I make it clear that after the enquiry if the respondent no. 1 finds any merit in the complaints made by the petitioner, the respondent no. 1 will take appropriate steps against the erring officials in accordance with law.

With the aforesaid directions and observations this writ petition being WPA No. 11331 of 2020 stands disposed of without any order as to costs.
