The petitioner is the plaintiff in Title Suit No.40 of 2018 pending before the learned Civil Judge, Junior Division, 2nd Court at Durgapur.

The petitioner is aggrieved by the delay on the part of the learned court below in passing the judgment in the said suit. It appears that several dates have been fixed by the learned court below for passing judgment, but the proceedings were adjourned. It is informed that the next dated fixed in the learned court below is February 22, 2021. Without going into the merits of the claim of the petitioner and without making any observation with regard to the contention of the petitioner, this Court is of the opinion that justice would be sub-served if the learned court below is directed to dispose of the Title Suit No.40 of 2018 expeditiously within a period of two months from the next date fixed.

The petitioner is directed to serve copies of this revisional application along with server copy of this order upon the opposite parties within a week from date. It is made clear that the learned court below will proceed independently and in accordance with law. The revisional application is disposed of.

There will be, however, no order as to costs. Urgent Photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Shampa Sarkar, J.)
