Mithilesh Kumar v. State Of West Bengal
CRM 10993 of 2020 28.04.2021 In Re: An application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure filed on 21.12.2020 in connection with Bankura Police Station Case No. 59 of 2020 dated 15.03.2020 under Sections 395/397 of the Indian Penal Code (G.R. Case No. 288 of 2020).
and In the matter of: Mithilesh Kumar ...... Petitioner Mr. Swagata Datta, Advocate ......for the Petitioner Mr. Md. Anwar Hossain, Advocate Ms. Sreyashee Biswas, Advocate ...... for the State Court No. 02 Item No. 136 snandy (anti-bail rejected) Indubitably the petitioner is already in custody in connection with other cases.
According to the learned Advocate for the State the petitioner was arrested subsequently for the commission of offences and the production for the purpose of identification could not be done despite attempt has been made in this regard.
After considering the statement of the de facto complainant and the other witnesses including the co-accused, we do not think it is a fit case where the petitioner is entitled to have the privilege of anticipatory bail.
The prayer for anticipatory bail is rejected. The application being CRM 10993 of 2020 accordingly dismissed.
